Leave encashment

Hi,

 

I worked for a comapny called mainstay teleservices in bangalore. I quit on 15th  Dec 2010. I had 18 Earned leaves pending. I was told that it will be encashed in my F & F settlement of dues but they told me that it is encashed only on basic which is a mere 3500 rs a month while my monthly gross salary was rs 35000. Is this legal or is the company right about the leave encashment policy. What does labour law state in this respect?

In our organisation we encash leave on basic only & this is standard procedure. When an employee quits job without serving notice peroid then also propotionate basic amount is being deducted from full & final settlement.

If you have DA as separate component, then it should be added for leave salary calculation.

In general, leave encashment will be done on Basic+DA.
