1. negligence on the part of victim
2. any medical problem
3.attempt of sucide
4. under intoxication e.t.c

are you defending an insurance company or the owner/driver of the vehicle which is being questioned?
you can also take the help of the judgement passed in the criminal court... If driver is acquited by the criminal court that could be a good defense.
I am not sure how to defend if the driver has pleaded guilty... May be someone else can answer this part.
