Copyright of Translated Works

I have just finished the translation into Gujarati of an English book published in the USA.  It took me and my collaborator 2 years of work.  We are in the process of negotiating with the original publishers.

My intention is to be fair both to the original author as well as to us.

 

I would like clarification as to the copyright of the Gujarati translation:

 

1. To whom  does the copyright belong under the international copyright law state?

 

2. What does the Indian copyright law say about this issue?

 

3. What does the Indian law say with respect to fair use of the translated material.

Please find below response to your queries

1. To whom  does the copyright belong under the international copyright law state?

  Copyright belongs to original author. it is just translation to other language, any language expert could have helped.

2. What does the Indian copyright law say about this issue?

  Copyright law protects internationally under Berne's Convention law.

3. What does the Indian law say with respect to fair use of the translated material.

For the translation & distribution of  book there should be prior approval from the original author. Definitely you need to pay royalty.

Q) Have you started working on this translation after negotiations or are you going to negotiate it now after the completion.......... if you have negotiated earlier what are the terms.....
