Builder asking for maintenance charge

Hello,

I had purchased a flat from Mr.X in Jan 2011.

Mr. X had sold it to the builder in Jul 2010.

At the time of purchasing our flat, the builder had clearly stated that we give 15 months Maintenance in advance. We did that. 

But now, he is counting those 15 months from Aug 2010 (which is the agreement date of Mr. X) instead of Jan 2011 (which is our agreement date).

Kindly, let me know who is liable to pay that Maintenance charge?

AS PER RULES

IF BUILDER HAS COLLECTED 15 MONTHS MAINTENANCE IN ADVANCE THEY HE IS SUPPOSED TO GIVE MAINTENANCE TO THAT DURATION THEN HE IS SUPPOSED TO HAND IT OVER TO BUILDER

 

ELSE WHAT IS HIS ARRANGEMENT WITH HIM

 

 

 

Kindly, let me know who is liable to pay that Maintenance charge?
