Arushi Case: SC stays trial proceedings, relief for Talwars

Aarushi case: SC stays HC order against Talwars

 | New Delhi, March 19, 2011 | Updated 20:40 IST ____________________________________________________________________________________

The Supreme Court on Saturday stayed all proceedings against the parents of slain Noida girl Aarushi Talwar. The dentist couple -- Rajesh and Nupur Talwar -- had approached the apex court challenging an Allahabad High Court order passed on Friday wherein it had upheld a Ghaziabad special court decision to make the Talwar couple stand trial and rejected their plea against the initiation of criminal proceedings. Giving relief to Talwars, the two-judge bench directed them to submit their passports before the trial court by Monday. Earlier in the day, Talwars had sought stay of criminal proceedings against them in the case. The high court had dismissed the criminal revision petition of Nupur against the designated CBI court proceedings saying the petition had failed to provide any valid reason warranting the court's intervention at this stage. The high court had said that it could not prohibit the magistrate from taking cognisance of a case if prima facie it appears that there is sufficient evidence against a person. It had asked Nupur, who submitted she had been summoned despite never having been called for interrogation or having been named as an accused in the CBI's closure report, to appear before the trial court within two weeks. Another petition filed by Rajesh challenging bailable warrants issued by the Ghaziabad court on February 28 was also dismissed by the high court. On February 9, the Ghaziabad court had issued bailable warrants against the couple and ordered initiating proceedings against them after it had named them as main accused. The lower court had rejected the closure report of the CBI, which had said there was insufficient evident to prosecute them. The 14-year-old Aarushi was found murdered in her bedroom at the Noida residence on May 16, 2008. A day after the family's domestic help Hemraj, who was named as the key suspect by the Talwars, was found dead on the terrace of the same building.

if she is really her wife she shoul be asked these questions no matter whatever the justice may be....!

blaming anybody(court) is easy but rectifing urself is hard or impossible???
