498A first date in court

Hi,

498A first court date is in another 10 days.  Could see this info in AP police website. However the accused have not received the summons/notices from court so far.

Questions:

1. If summons/notices, do not come before the first hearing date, do the accused still have to appear before the court ?

2. Normally , How many days before the first court date, will the summons/court notices be sent ?

3. What usually happens during the first court date ?

4. Is it mandatory to have a Lawyer that I should appoint before appearing for first date ? I am still in the process of finding one good one.

PS: All the accused got the AB and currently on bail.

Hi,

 

The first date is always fixed for the appearance of the Accused, if summons are served to them. If summon is not served before the date fixed for appearance then the Court Re-issues the summon against the Accused. Normally the court issues the Summon before 30-45 days before the first date. (if any of the accused is not the resident of territorial jurisdiction of the Court then court may fixed the long date- its the  discretion of the Court). On first day the accused just secures his presence and appoint his Lawyer for further proceeding. If summon is not served on the Accused, he may not appear before the court as he has not received written order of the Court, Even though is know it orally from other sources.
