leave & Licence agreement

i have a commercial premise been given on registered leave and license for 36 months.this agreement has a clause stating that the licensee agrees tht the possession of the license premise always remains with the licensor and he is not able to create a third party interest or sublease it and in our compensation/Licence fees section we had written that continue default for 2 month the license is automatically terminated and security deposit will be forfeited .
we issued legal notice to licensee regarding unpaid Licence fee for last 5 months which he is unable to pay .he directly approached to small cause court for injunction and my lawyer put application for 7 rule 11 but the judge is not convinced for 7/11 my lawyer is saying that there is no relation between licensee and licensor now because the license is terminated.
kindly suggest what step should be taken?
