My father did a unregistered sale agreement on Aug2010, but did not sale land ,now opposite party file a suit that we are not willing to complete the agreement,and our advocate put a point that agreement is not registered so it is invalid docs,but judge is telling there is no ruling available from HC on this topic so he will decide this point at the end of decision ,this disput is in satna a district city in Madhya Pradesh
1) Can any one tell whether judge is right o\?
2) what step we need to take?
3)should we put a petition in front of High Court(HC) to know whether agreement is invalid and stop the case proceedings?
