Issues in sale deed registered

Hi Sir / Madam,

In the sale dead, behind the first page, as you know there is a process of obtaining thumb impression of buyer and POA/vendor. In the same page, there are two witnesses whose names are written along with their address and they are expected to sign...If the names of one or both the witnesses are not apearing clearly because of alteration or poor handwriting, is this an issue?

If yes, I guess rectification deed is required. In that case, should the POA be available or the vendor is required to execute the rectification deed?

If the deed is registered under the signarture of sub-registrar and entry thereof has been made in Index / book No. I, I am of the opinion that this will not be an issue for rectification of deed...

Dear Mr.Pervez, Thanks for your opinion. Yes, the deed has been registered signed by sub registrar. Am not sure about entry in index. However, in the encumbrance certificate, the name of buyer, seller is reflecting correectly. Is this fine.

witness name and address note down in record of sub-registrar office and i think they give a photoprint of Vendor , Purchaser and witness and sign in this page.

Dear Mr. BharatKumar,

 

Yes, they take photoprint of vendor and purchaser. However, they do not take any id proof or photo print of witness.
