on jungle book copyright.

hello,

we want to use jungle book theme n characters for promotion of a store. we will make new illustrations. i want to know if there would be any copyright issues if we use name of characters, does anyone have a copyright to the book as it is more than 100 yrs old?

Dear Manish,

"Copyright shall subsist in any literary, dramatic, musical or artistic work (other than a photograph) published within the lifetime of the author until fifty years from the beginning of the calendar year next following the year in which the author dies".  The Copyright is liftime plus 50 years and in some countries 60 years after the death. If this is the case then book might not have copyright issue. Check, when did the author die. Please note this is only for coyright issue in literay work. However, Junglebook TV serial must have copyright since, it is a combination of literary, dramatic, musical or artistic work  and constitute a totally seperate work.

Take the advice of a good copyright lawyer to avoid any infringment issue

many many thanks for clarifying the same. right now its a small ad in an inhouse magazine, if the response is good and the company decides to release it big, i shall surely forward your name to them so that they can avail legal counsel by a professional.
