1) flat is booked BEFORE marriage

2) Possesion of flat AFTER marriage

3) husband and wife never stayed in flat

property is self earned

does wife claim any share in property or stop sales ? under which clause?

On whose name the property is registered ?  the property belongs to the person on se name is registered.

So long she has claim over you she has claim over your goods and assets.

1. No. She has no right on your said solely owned property during your lifetime.,

2. If she has filed a Divorce Suit, she can claim maintenance or alimony but not share of your property during your lifetime.

While I respectfully disagree with the views of learned Senior Adv. Mr.Roy, I fully agree with the learned Mr. Ganguly.  Whether the property bought before or after marriage, if it is a self acquired property, only the person who purchased it has got full rights over it and nobody else during his life time.Further, even if you both have stayed in the flat after marriage, she cannot lay a claim on it on that basis too.  There is n o such law entitling her for such a claim, at least not now. So if she does not have any right over it, she cannot restrain you from selling it.
