Leave and License Agreement

Dear all,

Please provide your valuable suggestion in this matter:

A leave of license agreement was entered in which the tenure was mentioned for a period of 11 months starting January  2009 (ie November 30, 2009.)

But inadvertently it was mentioned October 31, 2009 instead of November 30, 2009.

What would be the correct tenure of the Leave and license Agreement in this case.

Would it be 11 months starting from January 2009 (ie. till November 30, 2009) or would it be October 30, 2009 which is the date mentioned in the Agreement.

11 months period is the important factor.   Taking into account the same, the period is only November 30, 2009.  You need not worry about the inadvertent mistake (30th October 2009). 

Moreover in case of any dispute, the courts would normally look into the intention of the parties.  In your case the intention of lessor and lessee is 11 months and hence it is only 30th November 2009.
