1960-indian origin person born in africa -married in india -

 Inthose time there was ship that migrated people from Africa. Aeroplanes was not the mode of transport.

A Hindu person born in Africa of Indian origin  having British Passport came for study purpose in the year 1959-60 , later was married an Indian Hindu person in the year 1965  and has settled down in India, doing his professional Business owning an Pan card, paying Income tax etc..He has been paying filing Income tax returns since last 30 years.

What is the status of this person's citizenship.

The person has not applied for the passport, wants to apply but he  is not sure about the citizenship status.

The said person has birth certificate of Africa and also the old British Passport.

How can he apply for an Indian Passport.

The person you are describing is a Person of Indian Origin (PIO) provided he satisfies the following:

 

"Any person:

  • who at any time held an Indian Passport; or
  • he/she or either of his/her parents or grand parents or great grand parents was born in an permanently resident in India as defined in the Government of India Act, 1935 and other territories that became part of India thereafter provided neither was at any time a citizen of any country as may be specified by Central Government from time to time; or

who is a spouse of a citizen of India or a Person of Indian Origin as mentioned above.

The scheme is broad-based, covers up to four generations and also the foreign spouse of a citizen of India or a PIO"

 

Let the person apply for PIO Card to start with.  The details for obtention of PIO Card are available in the following web site of Ministry of Home Affairs:

Later the person can apply for Indian Passport. If he is not eligible for applying for PIO Card, he can apply for Indian Passport giving the reasons for applying for the same.
