Section 11a of the land acquisition act, 1894

 Hi

 

My query is the Land acquisition officer had issued an order for acquisition but the order from Collector was not issued within the time frame of 2 years provided in Section 11A of the old land acquisition act. Now will the proceedings lapse or is there any contention which can be given in this matter

According to Sec. 11-A, an award u/s 11 should be passed within 2 years from date of publication of the Declaration u/s 6 of the Act. Otherwise, the entire proceedings will lapse. If you want to confirm, you go through the Act.

The law says if an act in a statute is to be done in a particular way then it has to be done in that way only and if not done then the procedure followed is bad in law and hence needs to be quashed.
