So called probation rule comes to punish in iti ltd a psu

Respected Sir, My fact of Case /case History is as under-

I am a confirmed officer in a cpsu,ITI LTD. I have applied in DFCCIL A railway PS U with due NOC and got a offer letter dt: 12/09/2013 to Join at New Delhi on 12 Dec.so i tendered my resignation letter of 90 day notice which is due on 10-12-2013.

In the Mean while on sep 04 ,2013 I got Promotion in ITI as Vig.Officer and opted my pay fixation from date of Promotion i.e. Sep04.2013. Now my HR deptt. has given me a letter that Since i am in probation period so My resignation will be accepted as I have not been promoted as my probation will not be complete so I will be deemed as revert back in my earliear Post as Avo.

Noe my Quarry is 1. If my HR is correct and as per Rules 2. what is my Fault if have not Fixed my pay at 4th SEP 13 and Just In last pay certificate I will be a looser.

Pl. Have look in my case and send me Your Opinion in this case.

Please intimate if CDA rules of ITI Ltd do have anything paralell to rule 23 (iv) of CCS(CC&A) Rules.
