MOTIVE IN CRIME - Significance Of

1.What is the significance of MOTIVE in a crime?

2.What is the outcome if the prosecution fails to prove the motive in a crime i.e the theory put forward by the prosecution, or the reasons given for the crime?

3.Can a trial be conducted without spelling out the motive in the crime by the prosecution?

There is no straight jacket formula. In cases of circumstantial evidence, the motive is important. You have to refer the defination of criminal act to find out if motive has significance. If one kill a person it is called Homicide but ifhehas no intention to kill a person he will be given lesser punishment and will not be held guilty for murder.
