Dear friend, for non-compliance of Or 39 R 3 will not automatically seize the proceedings of particular I.A. but order of injunction passed thereon will become non-est. You may go along with same petition for order on merit.

The order stand vacated. In other words the order goes. However, it was an interim order. You can get the same order as permanent order by contesting your suit on merit.
