By way of amendment alternative relief of
possession is sought in suit for specific
performance – Contention that amendment
must be made within limitation – Relief of
possession is consequential to relief of specific
performance as per 1982 (1) SC 525 – Hence,
Art.137 has no application – Contention in this
regard is liable to be rejected.
