Dear all,

What will be the status of DV act case if petitioner( wife) does not appear for evidence citing some reason??

Can the case be dismissed right on the spot or else will she get few more dates??

The court will give her next date if the reason given by her is proper.

She wont come until such date when the case is posted for final orders/dismissal. Then out of nowhere she will appear like a genie. So you ask your advocate to pressuirize the magistrate to move the case forward, and to dismiss the case.

in once hearing of evidence if she is not present no court will dismiss but rather will give chances for three and more also if the reason is genuine

normally at the time of evidences and arguments stages the petitioner or the lawyer will take such time and the case will run for months
