Once recovery suit - OA is filed in DRT and decreed, a recovery certificate is issued directing the Recovery Officer to recover the dues. It is not an Execution Proceedings. In practice till the Recovery Certificate is withdrawn, the proceedings cancontinue and can be kept pending even after 12 years. No judgment is yet available to hold that Recovery Certificate is barred by limitation after 12 years[as applicable to EP]. If the Debt Recovedry Proceedings is kept pending or adjourned sine die, then no limitation applies. It can go on for 100 yeras also.
