Fit out possession

Hi,

I have booked a flat with builder in Faridabad, Haryana in 2008.

Builder has issued now a possession letter for fit-outs wherein he is asking for all final payment with stamp duty and all other charges but not giving us physical possession. I am sure he has also not received occupancy certificate since he is not offering us physical possession.

Discussing with supplier about fit-out possession and offer letter states that it is ok for you to start fitting and furnishings but i think accepting it will put on risk on me since if the construction is not good than I will not be able to take legal step against builder.

What should I do to stop " FIT OUT POSSESION " from builder ?? Is it legal or Can I take any legal action wherein I don't want "FIT OUT POSSESION " but want physical possession only. Builder has also mentioned about charging of interest If i dont accept the offer for fit-out possession.

Pls suggest asap.
