Case is : Father has acquired a property with wife as co-owner. Father has expired. The couple has 1 son and 1 daughter. There is No Will made. The daughter is married off about 10 yrs back. The mother wishes to give the flat to the son only and Fix Deposits share between the son and daughter. The daughter has given a No Objection to get the Brother's name appear as co-owner with mother. accordingly, the Nomination form has been submitted to society.
The mother wishes that a Will be done so that there is no quarrel of any sort between the brother and sister.
(1) Whether the Will requires to be registered?
(2) Whether it attracts any stamp duty?
(3) the inclusions inthe will may be as : Flat to the son, Fix deposits to be shared equally and some Gold to be given to the daughter and balance for the son. Whether any valuation etc?
