Dear members,
can a woman claim maintenance from her husband and her son at the same time in a proceeding u/s.125 crpc?can a women claim maintenance from her son when her husband is living and not earning?can husband and son of a woman can be added as respondents in a proceedng u/s125 of crpc?
kindly give your views.....

yes ,you can file case as both respondents son and husband

Although right to maintenance forms a part of the personal law, but in order to protect women and children and provide a swift and cheap remedy against neglect and refusal to maintain, a secular safeguard irrespective of personal laws of the parties was necessary. With this intention Sec. 125 was inserted in the Cr.PC.
