Precausion befor 498a start

Hi All,

 

My brother is on regular bail for past one year. Right now he is fighting DV, 125 crpc.  I know 498a is about to start very soon. Can we do somthing before IO file the chargesheet ? Or do you guys recommend any precause so that we should have less hassels in fighting 498a?

Hi,

Laywers would surely give you right advice on precaution and strategy !

But I would like to jump here to mention 2 points

1) The Defence Strategy : Be ready for long term battle;; If your opponent wants to make sure you are not happy ever

2)  The best strategy would be attacking: Be aggressive; let them face the taste of Indian law as well.

Keep patience.

Collect evidences.

Write rti against her n her family memebrs.

File some criminal cases on them after strong proof.

Fight the case with merits.

Dont pay any extortion money.

Read and know the basics of law.

Learn to be Still.

 

CS would cement the case. Take the copy of the CS and then study it thoroughly.

Can witness change their statements in court after CS?

What value witness statements has in CS?

The witness can complaint prior to changing the statement after the CS is filed.

 

However, the state case is the case of prosecution, complainant has limited say in the matters.
