Pagdi rental dispute with landloard

Dear Sir/Madam,

We have old house rented premises in south mumbai under pagdi system before 1943.

There was no rental agreement with landlord.

Rent receipts was in my dads name till 1999, my dad died in yr 1986, landloard continued accepting rent till 1999 and issued receipt in name of my father, after which he had stopped accepting rent, we tried sending money orders several times but refused to accept it and we have return receipt of money orders as records.

We have water line meter in our name from Yr 1994 (agreed with landloard in municipal corporation ) electricity meter in our name from 1974.

Several attempts to pay rental from our side was failed, lanloard died in yr 2001, still property  card is in his name of landloard till 2012. and both sons are not accepting our rentals since building is mortgage with bank for outstanding loans.

We would like to know our legal position in this case.

how safe we are if bank goes for auction for non payment of landloards loan.

Rent is due and not paid from Yr2000. landloards legal hires not caliming rent and now we are not making any attampt to pay the same. Is there a way to pay rentals in court.

How can we protect our selves. please advice.
