Bw and nbw to pw2

pl. clarify---BW is issued to PW2--father of complainant in 498a case; he appeared in last week of Nov 12 and proposed some compromise.  I did not agree for it and judge ordered to continue the trial;  next date is 31.12.12.

 

if PW2 does not come on 31.12.12 for chief and cross examination, can I ask for issue of NBW till chief and cross examination are completed?

what steps would be taken by judge if PW2 does not come on 31.12.12 and his appearance on last adjournment date was only after  issue of bailable warrant.

Non bailable warrent will never be issued against any witness. Witness can not be equated with accused, Hence, please don't expect for that from court to do that.

Rather, if PWs don't appear in cases, court will decide to close PW and proceed for DW. It will ultimately in favour of you.
