498 a quash

Hello Members,

My lawyer is saying that i have a strong case for quashing in high court with good grounds but as the police has filed the chargesheet so high court will ask to go for discharge in lower court.

Pls advise how does it matters? What can be done to make sure that case is accepted in high court?

Thanks

When the Chargesheet has been filed? Whether any stage of trial has been commenced or not?

FIR was lodged 6 months before..chargesheet if filed 10 days before..trail is not started yet.

Discharge application is the best way to move forward.

In discharge I am not allowed to submit any documents from my side whereas in quash it is possible...till last month it was a good case for discharge but now police has added more allegations taking supplement application from wife....now they have included some wild allegations which is making good grounds for quash but in discharge i will not get a chance to prove these allegations which easily can be proven false if i get a chance to prove it.
