Doubt on settlements in partner's retirement

Hi ,

  Would be greatful if someone guides me in this problem.
There is a partnership firm managed by 4 partners(equal sharing 25% each) . They just set up the company 2 months before . There is no profit made by the firm as such. Out of four partners , one is not showing intrest , also not contributing amount for employee's salary or any other expenses for  the company. Now he is saying that he will resign from the partnership.

My question is , he is liable to the company's expenses untill he resigns his partnership. Suppose if he resigns today , should he has to settle his part on  all the liabilities incured till date for the company ?If so , is there any legal proceedings by which the capital can be claimed since he is refusing to settle it.
