Khatha tranfer of inherited property

Hello All,

My father had purchased agriculture land  few years back and had a valid title of the land.
 He passed away last year. As per the query and the valuable feedback in your

website, my mother and we three sons are the legal owners of the property.

Issue:::::::Wanted to get the Khatha transferred>

Options A: Transfer it to my mother:

Checked that  we need:

a>Family tree

b>Afffidavit from my mother to transfer the katha to her name from my father

c>Affidavit from we three brothers to transfer the katha to her name

d>Letter from my mother to Tahsildar to to transfer the katha to her name from my father

e>Copy of Death Certificate

Got this documents ready, but one of my brother is not signing the Affidavit

 

Option B: Get a Joint Khatha in all our four names (mother and 3 sons)

a>Family tree

b>Afffidavit from my mother to transfer the katha to her name from my father

c>Affidavit from we three brothers to transfer the katha to her our names

d>Letter from my mother and sons to Tahsildar to to transfer the katha to her name from my father

e>Copy of Death Certificate

Got this documents ready, but one of my brother is not signing the Affidavit

 

Queries:

1>Please clarify the options for Khatha transfer if one of the son is not signing, how do we resolve this issue

2>The property needs to be divided to four parts for the four people

3>Whom should we contact for Katha Transfer ?

(Heard that we had to submit documents at Nemmadi Kendra, but on enquirng at Nemamdi kendra they

said it has to be submitted in Village Panchayat office, so not clear)

To get patta transferred into your name, you will have to submit an application to the Tahsildar of the area where your propperty is located enclosing a xerox copy of your title deed, requesting him to issue patta in your. If the title contains your name alone, it will be easy to change the patta, suppose it contains more name as shareholders of the same property, then you have to get them excluded procedurally and legally.
