Is this cheating - pls respond

Hi Experts,

My query is that Mr. X admit and given sworn affidavit that he had sold his piece of land for Mr. Y and gave him some lacs of rupees to perform his daughter marriage with Mr. Z. But the truth is that piece of land never sold by him and still exist in the name of Mr. X. Can Mr. Z apporach court to file cheating and criminal conspiracy case against Mr. X and Mr. Y.

1. the deal was within x and y. z is not affected.So there is no grounds of cheating.

2.There no loss of z as against any property, mere representation is no offence.

whether this deal be effected to the quariest and in what manner ? until it does not effect to other there is no mean as to cheat

In the instant case, case of cheating is not possible. However a case for lying under sworn affidavit (perjury) can be made out.
