ravi shankar (consultant)     10 April 2012

2 charge sheets-single crime

accused in a crime u/s.420 cr.p.c. in 2008,was denied bail in crl.o.p.24866/08 on the grounds - FINAL REPORT was filed- this was not the case,as later the lower court granted bail after 181 days;

the complainant on a false complaint,supposedly representing a company filed the complaint,which resulted in the fir/arrest etc.,

now the COMPANY has sought a direction to file the `final report'-without notice to the accused.

- IS THIS ALLOWED?

- CAN THE ACCUSED FILE A PETITION AS INTERVENOR?

- WHAT ARE THE OPTIONS AVAILABLE TO THE ACCUSED - TO OBTAIN A DISMISSAL OF THE PETITION?

- THERE IS A COMPLAINT REGISTERED - as directed by the courts u/s.156(3) against the complainant and the I.O.

ADVISE URGENTLY REQUIRED PLEASE.

thanks and regards
