It is reported in daily news that many incidents of fraud marriages on either side, which later turn to be bitter relations which hampered sacredness of Marriage. Before marrying Ensure Thorough background check of your would-be spouse, so later either side wont turn to be an Enemy on small Petty Issue. So let’s understand few vital laws on Family in India, which instruct newly wed husband to ensure safety & rights of your Wife.

 

  1. 498a, More commonly Know as Dowry Law in India where Women go to the police with a complaint (may be false, Even without proof or exchange of Dowry), but the system provides to record that as a criminal complaint against husband or any of his Family Members. It is Non-bailable, Cogzible & Non-Compoundable offence. Here first Husband & his Family face arrest & Jail, Rest Proceeding takes place later. Most of those cases runs for 5-7 years in which 98% cases are false.


  2. Domestic Violence 2005, Most Commonly as “DV Act” this law Singles out Men/Husband as perpetrators of DV and assumes that only women are victims. As per this law, only a woman can file a complaint against her male partner. A man, who is a victim of DV, has no rights under this law. Laws says on “sole Testomny of Women” she can get relief. Some of the Important Notes which you must know i.e. it Covers

    Verbal & Emotional Violence Means

    Insults, Name-Calling, Accusation, Preventing from taking up / leave a job, Preventing a child in your custody or from leaving the house; Preventing you from meeting any person or forcing to get married when you do not want to marry. Or preventing from marrying a person of your own choice (Even you are already Married !)

    Forcing you to marry a particular person of his/their own choice. Threat to commit suicide (Even she threats you that is OK!)


    Economic Violence covers

    Not providing money for maintaining or children, not providing food, clothes, medicines etc., stopping you in carrying on Job, Taking away wife income, salary or wages etc. or not allowing to use your Salary, Wages etc.
    Forcing out of the house you live in. or Stopping from accessing any part of the house.
    Not allowing use of clothes, articles or things of general household use,
    Not paying rent if staying in a rented accommodation etc.

    ANY other act of domestic violence is committed against by a person (here means Men/husband’s relatives) with whom you are residing in same house,

    The Beauty of this law is it allows wife to have Rights to Residence and Same time Restraint Order from Court to restrict Entry of Other house members to ensure the safety of Women :)

    Means! you can be kicked out from your Own house by your Wife/female Livein Partner. That is not enough....

    Also She can claim compensation as per DV Act in Lacs depend on your ability to pay.

 

It is reported many husband have faced above cases after getting married, after which demand for separate home, one time Settlement and property demand, and many others kept by Bride family to drop the charges against husband & his family.

Moreover, Rights Property Act in 50% Share in Husband’s property by wife is also proposed by Indian Law System

The Whole Idea here, If Marriage Registrar, Counsellor or Any Pandit, Qazi or Preist...

giving Date of Marriage also provide Small Leaflet, which gives Both Couple to Understand these Laws.. If any SMALLEST clue from either side can stop LOONG Battle...

Which can Save Many Years, Especially of Groom side. Most of this time NRIs are Victim They dont have Even any slightest Idea about these laws and gets Screwed..

Iam one of the NRI Victim never imagined of being arrested,Jailed for False Dowry & DV Acts.Please do make background check then go for marriage....
