Apartment - liability

I thank all the gentlemen who answered my question a couple of days ago on the toilet built illegally on the terrace. As mentioned, the toilet had been built illegally and much against our objection before I got it demolished by the municipal authorities. Since the secretary of the association of owners of the flats had also given his green signal to the construction, we want to make the secretary also a party to the complaint.

My doubt is: Does the consumer law make the association (or any office-bearer thereof) also liable in a case like this or is it just the builder? Since I pay for the monthly maintenance of the building, do I not become a consumer vis-a-vis the association? If so, are there any judgements which I can cite before the consumer commission?
