Non-payment of matured deposits by company

 What is the procedure of filing an application for non-payment of matured deposits by a company (NBFC & non-NB FC)  before the Company Law Board?

first u send a legal notice cover with all facts and demand to pay, later consumer court.

 Its better to approach a Consumer Forum for speedy disposal of the matter. Issuance of notice is not mandatory.

In my view if the NBFC or Non NBFC whosoever has defaulted the payment, the best option is to approach the RBI even before approaching the CLB. I suggest you take the matter with RBI since it is the regulatory body for acceptance of deposits by companies. Infact, Companies act restrict acceptance of Deposits by Bodies corporate who are licensed to accept deposits with prior approval of RBI, incase there is no approval then companies act bars acceptance of deposits from public. In case RBI fails to take action you can approach the court, which will be the last resort

First, you lodge compliant to ROC through Investor Complaint form mode (It available at www.mca.gov.in). In case, the default company is a NBFC category, kindly file complaint to RBI also. The matters do not resolved,

Thereafter an application files for non-payment of matured deposits by a company (NBFC & non-NBFC) before the Company Law Board.
