Professional misconduct on part of an Advocate

The Defendant made contradictory statements:- 1st :- I am the owner of the shop. After 1 year he said 2nd I am not the owner of the shop. He has not withdrawn his original statement. He still continues with both the statements. In both statements the Advocate is same. Q.1 Is it not a professional misconduct on part of the advocate? ( Note I have already filed the Perjury case against the Defendants u/s/ 195 and 340 of Cr.P.C.)

It can not be professional misconduct of the advocate. Perjury will also be applicable only when in what context both these statments are made.
