Plot owners formed an association and given GPA to its secratary to file a private complaint before a Metorpolitan 1st class Magistrate regarding their plots purchased on behalf of their association against a Real Estates & Construction Firm and the same done. The Hon'ble Court referred the matter to concern P.S to investigate into the matter. As usually the concern P.S submitted their final report before the Hon'ble Court stating that the matter is in civil in nature. Complainant on behalf of the plot owners association filed protest petition and prosecuted the case. Meanwhile the present complainant who was a GPA holder of Plot owners association died with severe Heart Attack recently when the case is in pending. How the case shall be prosecuted? What steps be taken to add a new GPA holder to prosecute the pending case?
