RBI notes regarding cheque book issuance.

5.4 Issue of Cheque Books

Fresh cheque books should be issued only against production of duly signed requisition slips from previous cheque book issued to the party. In case the cheque book is issued against a requisition letter, the drawer should be asked to come personally to the bank or cheque book should be sent to him under registered post directly without being delivered to the bearer. Loose cheques should be issued to account holder only when they come personally with a requisition letter and on production of passbooks.

 

Based on the above can a mandate/loa/gpa/poa ( Not Account Holder) request a check book in the bank using a request letter instead of requistion slip.  If yes for mandate using request letter, What measures should the bank take before issuing the check book . Could some one please clarify the legality.

if he is not an account holder how can a cheque b issued 2 him???

Bank did not issue a check book to Account Holder, rather Bank issued a check book to someone who is acting as mandate. AS per the descripttion provided above by RBI , if it was understood, banks can not issue check book to a third party ( whoever it is mandate/gpa/poa/loa). In this case Bank issued check book. Was the interpretation correct ? OR any holes in here.

wat u mean by mandate......................he is acting as and on whose behalf.......has he shown any thing 2 prove he is one?

Power of attorney holder can get cheque book of the master.

Power of attotney holder can get cheque book --> yes --> Provided that particular clause is added that POA can get/ request/collect  check book specifically.

 

 What do you mean by mandate --> Banks these days and in earlier good old days 6/7 years back used that Term as Mandate and now Letter of authority/poa/gpa as per understanding.

In this case ,as RBI guided above, can bank issue a check book using a  request letter instead of cheque requisition slip though there was no given permission to get/request/collect cheque book.

if in the letter no request was made 2 give cheques to the mandate by the bank concerned and on verbal request the cheque was given then its the fault of the bank...it is required by the bank 2 find out by the real client.......as per the section mentioned above by you it clearly says that the party or a/c holder shuld cum to the bank to collect the cheque books in case of requisition letter.......

it will b difficult 4 the bank to put the blaim on the a/c holder if there is no request has been made in the letter 4 issuing fresh cheque books........
