ORDER

1. The Principal, Bapatla Engineering College, Bapatla, in his letter dated 23-09-2006

brought to the notice of the Commission that according to the Judgment of the

Constitutional Bench of the Hon’ble Supreme Court of India, delivered in TMA Pai and others Vs State of Karnataka and others, there should not be external control from the Government in day to day administration of Private Educational Institutions and that even though they do not come under the definition of Public Authority u/s 2 (h) of the RTI Act, 2005, the Principal submits that with due respects to the kind authority of the Commission, they are submitting information.

2. The Commission is of the view that the stand taken by the Principal, Bapatla

Engineering College, Bapatla appears to be wrong, which is against the definition of

“information”, as defined u/s 2 (f) of the RTI Act, 2005 it is clear “information

relating to any private body which can be accessed by a Public Authority.

3. In the light of the above, the Bapatla Engineering College, Bapatla will come under the purview of the provisions of the RTI Act, 2005.
