We have been challenged by defination of Income referring a judgement 292 of 1997 Dated 18/11/2003. State of MP Vs Awadh Kishore Gupta (2004)

However as per our understanding first of all:
1. If the IO has taken an "Income" in the chargesheet then it has to be considered in the income and not changed because PP has brought a new judgement altering defination of Income
2. Any sort of "income from Known Sources of Income" should fall under the category of "Income" and should be considered to calculate disprotionate assets of a public servant
Does anyone has any clue / help with any judgement etc on this
