Dear All Experts,
One of my friends has been arrested by the police on 12.11.2010 under section -409 of IPC and was sent to judicial custody on 15.11.2010.We applied for Bail before Judicial Megistrate on 18.11.2010 and hearing for bail took place on 19.11.2010.Although The Investigating Officer had nothing original besides some fake documentary proof against my friend nonetheless the judge refused bail on ground that Section imposed on arrested person is IPC-409 and the investigation is going on.
IS there any time limit under which only we should apply for bail?
My friend is a innocent person and no money of any kind from anywhere has been recovered by the Investigation officer and his company has falsly implicated him.The amount which the company falsly imposed on my friend is Rs. 16,35,000/-.
Please advise what should we do to release my friend from judicial custody in Tihar Jail,Delhi as early as possible?
What should be our next course of action?
