First of all there is Board for inquiry o f Juvenile  cases, who is in Conflict with law. Once it is established  that the so called accused is / was Juvenile on the date of occurence , no court shall try this case and refer to the Board. There it will decided, The Board will look into the matter and take welfare steps as suggested in the Act.

Dear Nilesh,

AS you have mentioned that the accused person is a juvenile . If he has  been declared juvenile by juvenile board & his social and academic record is good then after considering these facts at the time of judgment the court will pass an appropriate order for the welfare of the accused person.
