some one purcheased a ibm laptpin the year 2007 when out of 365 daysonly 21 days left.as warrenty period .few months after purchasethere was gross dysfunctionand battery life gone.first verbal complaint followed by written complaint.finally moved consumer forum.district forum ordered---merchant shop is directed to pay cost of price rs 46000.or in the alternative replace or repair within one month.also to pay rs 10000for compensationand rs 2000 as litigation cost.op did nothing.complainant prefer an appeal to delate that portion repair or replacement.op also prefer red an appeal with petition forcondonation of delay.state commission disposed of both the appeals and confirmed order passed by dist forum.op now paid rs 12000.and wants to repair with cost since statecom confirmed dcrf judgment.few questions need to be answered.1)ld judge is earred in law by passing ajudgment with so many alternative.decree must specfy the specific relief.2)can the decree be amended at this stage?3) if execution petition is filed what should be the prayer?to my knowledge prayer should be direction to pay residual 46000 rs.since IBM sold out to LENEVO china ,IBM not MAking laptop and can t supply parts, moreover generation changed.on the other hand ex court cant go beyond decree.yr kind openion and advice please.
