pillion rider

Can legal heirs of a person, who is a pillion rider of the vehicle, in a motor vehicle accident can claim compensation by filing a MVOP? i need some citation in this regard. The insurance policy is comprehencive.

Comprehensive insurance policy:-


Death of insured-owner of a vehicle in  accident while driving the same. Insurance company not liable to pay compensation to his heirs under the act unless such liability is covered by terms of the policy. Even injured owner not entitled to compensation from insurer unless liability is covered by policy. By policy being comprehensive it does not mean that it covers liability arising due to bodily injury or death of the insured himself.
