Annulment is a legal process for declaration of marriage null and void. It can only be stated null and void if there are certain legal requirements were not met at the time of the marriage and then it is considered to have been never existed, legally.

Hello,Greetings of the day!

Annulment means having a marriage that is null and void or voidable from the very beginning that is void ab initio. In simple words, Annulment is a legal process for the declaration of marriage null and void. It can only be expressed null or invalid and void if there are certain legal requirements that were not met at the time of the marriage and then it is considered to have been never existed, as per the law. This is known as Annulment.

Annulment and Divorce are not Same-

The difference between annulment and divorce is that the annulment refers to the marriage which never existed at all whereas the divorce dissolves the existing marriage.

There are various grounds for Annulment:

  • Any of the spouse is already married.
  • Any of the spouse is minor.
  • Marriage without free will or consent of husband/wife is not there.
  • Any of the spouse is mentally unstable.
  • Any of the spouse is physically unstable.
  • The spouse who is married is sentenced to life imprisonment.

Illustration:

Mr. A intoxicated Ms. B and under the influence of alcohol at the time of the marriage; they made marriage. Here, Ms. B can seek for Annulment by the declaration of the marriage null and void from the very beginning.

Hope it helps
