Exclusive rights to the Terrace of a Flat

In the Deed of Declaration the builder has reserved exclusive rights to the terrace and has sold part of it to one of the buyers. Is this legally correct? Can the builder reserve the right to the terrace?

rights cannot be reserved they have to be exercised that too in accordance with law just go through appertant/ multi story building act seperate for every state in india. if aggrieved go to consumer forum. in any case terrace is all the time owned by inmates of the building if the stairs or the lift is common and not private.
