Construction contract

We have purchased a villa in a layout, as per the construction contract with the developers, they were responsible for obtaining necessary permissions/approvals to obtain electricity and water supply for the layout. However now they are claiming that they are not responsible for it and the individual villa residents should get the same done. Please help us in analaysing the solutions for the residents, should we file a complaint with the civil court or with consumer forum.

The developers cannot take plea that they are not responsible for obtaining electricity and water supply when it was written clearly in the construction agreement.  It is their bounded duty to provide water and electricity to all the residents. Refusal to provide them amounts to deficiency of service and you all can approach Dist Commission (Consumer forum) against the developers.

Violation of terms and conditions of contract and not obtaining electric and water supply connection by contractor amounts their deficiency of services.you may file complaint before District Consumer Forum having jurisdiction. and claim compensation.

You approach Rera Authority and complaint about the same.

Hello,

The developer has to provide water and electricity connection to the buyers. You can approach a consumer forum against the developer on the grounds of deficiency in services.
