title suit for father's share

a plot whose owner died 40 yrs back now there are 3 legal hier owner's husband,son, daughter.partition suit filed now after 40 yrs by daughter.how can they fight for father's 1/3 share who is owner's husband.he is willing to gift his share to me( 2 nd wife only son).can they override gift deed to ask for their share too.
