is penalty payment is mandatory in case of death of proprietor in gst

If proprietor got death in Dec 2018
and there is no one able to continue the business cause of that business got shut down but gst penalty due to not filling of return is going increase.
and also ITC lapse as per 16(4)

Please tell me if there is any way to get wave of the penalty. and any way to take input ITC for F.Y. 2018-19.

All the services related to agriculture including harvesting, cultivation, supply, packaging, warehouse, renting or leasing of machinery, etc. are exempted from GST. However, this does not include the rearing of horses. Transportation of individuals via public transport, metered cabs, auto-rickshaws, metro, etc

The penalty, with interest, could be realized from the estate of the deceased person. it is the first charge on such properties.

No person can escape from penalty and as per latest GST notifications you can file GSTR 3b from july 2017 without late fee
