employment vs advisory services

Sir, one of my client is an advocate, passed the AIBE exam and got registered with Bar council of the respective state. However he/she is in the employment, but he/she gives certain legal advises for which he/she gets some fee. Is it right ? Can He/She do so. I mean while in employment, can such service be given ? Kindly advise.

1. IF a Advocate is registered for "Practice" by the local Bar Council, THEN such Advocate CANNOT take up any type of "Employment" on Salary Basis.

2. However, the Advocate can provide ALL types of Professional Services (including Legal Report /Opinions /Advises, Drafting of any & all types of Documents, etc.... )  on "Retainership Basis" or "Assignment Basis", to his Clients, on "Professional Fees Basis" BUT NOT on Salary /Remuneration basis.

Keep Smiling .... Hemant Agarwal
