Recently company law has decriminalized the act with regard to non filing of accounts under section 137 of companies. ROC had filed against us before the amendment, but still the matter is continuing in the criminal court. ROC says it is not with retrospective effect. Kindly guide

I just had a query that upto what extent a act is to be amended so that its enactment year gets changed to the amendment act? And the company act, 2013 was just for example and not specifically to it.

T. Kalaiselvan, Advocate (Advocate)     18 January 2020

Your query is upto what extent an act can be amended.

The amendment is not to any extent but it is made as per the necessity of the circumstances under which it is amended.

Constitutional Amendment refers to changes made to an existing constitution. ... Any amendment to the constitution can be presented in the form of a bill and must be passed by a two-thirds vote of both the houses namely, the House of Representatives and the Senate, and ratified by three-quarters of the states.
